On November 28, 2017, Canada requested consultations with the United States concerning certain countervailing measures with respect to softwood lumber products from Canada.
Canada claimed in its request for consultations that the measures appear to be inconsistent with:
• Articles 1.1(a), 1.1(b), 2.1(a), 2.1(b), 10, 11.2, 11.3, 14(d), 19.1, 19.3, 19.4, 21.1, 21.2, 32.1, and 32.5 of the SCM Agreement; and
• Article VI:3 of the GATT 1994.
On March 15, 2018, Canada requested the establishment of a panel. At its meeting on March 27, 2018, the DSB deferred the establishment of a panel. At its meeting on April 9, 2018, the DSB established a panel. Brazil, China, the European Union, Japan, Kazakhstan, Korea, Russia, Turkey and Vietnam reserved their third-party rights.
On June 27, 2018, Canada requested the Director-General to compose the panel. On July 6, 2018, the Director-General composed the panel.
